Can I exit Canada after applying for Inland Spousal Sponsorship?

You can apply either for overseas or inland sponsorship for your spouse to immigrate to Canada It highly depends upon your need; to travel or work!

If you need to travel, you should choose to apply for overseas sponsorship. After requesting an overseas spousal sponsorship, you are free to leave Canada. If you want to go outside of Canada while you wait for PR, choose this option. On the other hand, applying via inland sponsorship is the best pathway if you need to work.

Although it is not advised for inland sponsorship applicants to travel outside of Canada while their application for permanent residence is being processed, some people desire to do both. This is because your right to enter Canada again is dependent upon the Port of Entry officer. Your application for an in-Canada will be canceled if you are not permitted to enter the country again. The reason being this application needs you to be present in Canada to get reviewed.

When a border official is aware that a spouse or common-law partner is already in Canada, entering the country becomes more difficult rather than simpler. A border officer may refuse your admission if your husband or common-law partner lives in Canada and you have formed your home there. In this case, you are not legitimately a guest who is planning to leave Canada and return home; instead, you are a resident of Canada.

Can I leave the country if I’ve received an inland sponsorship?

Can I leave Canada and return while my application for an open work permit is being processed?

If you apply for an open work permit and an inland sponsorship at the same time, if IRCC receives your application before the date your status expires, and if your application is approved for processing, it will be as if your current permit’s expiration date is postponed until IRCC decides on your work permit application.

What happens if I experience a situation where I need to leave Canada while IRCC is processing my application for permanent residence?

If an emergency requires you to leave Canada, get in touch with a licensed immigration practitioner (consultant or lawyer) before you leave. When you return from your trip, there is documentation you may prepare in advance that may be helpful to you at the port of entry.
